Terms and Conditions of Sale

These Terms and Conditions of Sale (“Terms of Sale”) govern the contractual and commercial terms applicable to booking and purchasing chauffeur-driven transport (VTC) and excursion services offered through the newrides.fr website and the NewRides Client and Driver applications (the “Service”). These Terms of Sale complement the Terms of Service. In the event of a conflict, for commercial matters (price, payment, cancellation, withdrawal), these Terms of Sale prevail.

2. Description of the services

NewRides operates a digital platform that connects clients who need chauffeur-driven transport (VTC) with independent professional drivers holding the licences required under French law. The Service includes on-demand rides and pre-defined excursions with tourist itineraries.

3. NewRides’ role as an intermediary

NewRides acts exclusively as a technology platform connecting the client with the independent driver. The transport contract is concluded directly between the client and the driver who accepts the ride. Each driver, as an independent professional, freely sets their own fare; NewRides is not a party to the transport contract and does not act as a carrier.

4. Conclusion of the contract

The client enters the pick-up and destination address; the Service calculates an estimated price based on distance, duration, chosen vehicle category and traffic conditions. After the client confirms the request, an available driver accepts the ride and the final price is displayed before payment. The contract is deemed concluded when a driver accepts the request and the price is confirmed by the client.

5. Prices and payment terms

Prices are expressed in euros (EUR), including VAT where applicable, and are calculated automatically by the Service. Payment is made by credit/debit card or any other method made available in the app. Loyalty discounts and referral credits, where applicable, are governed by Article 5 of the Terms of Service and by the dedicated information page.

For partner drivers: ride earnings are processed through the payment service provider Stripe Connect. Payouts to the driver’s bank account are not made immediately after each ride, but on a weekly basis, according to the payout schedule configured on their Stripe account.

6. Ride cancellation and no-show

The client may cancel a requested ride free of charge if it has not yet been accepted by a driver, or if it has been accepted but not yet paid for. Once payment has been made, cancellation remains free within one minute of that moment; beyond that, cancellation incurs a fee equal to 20% of the total ride price, to cover the driver’s time and travel. Failure to appear at the agreed pick-up point is treated as a late cancellation. If the driver cancels, the Service will look for a replacement driver at no extra cost to the client.

7. No right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, contracts for the supply of passenger transport services performed on a specific date or within a specific period are excluded from the 14-day right of withdrawal normally applicable to distance sales. By confirming the booking of a ride or excursion, the client acknowledges that the right of withdrawal does not apply, subject to the cancellation terms set out in Article 6.

8. Warranties and liability

Drivers who use the Service are independent professionals holding the licences and insurance required under French law for the transport of passengers. NewRides verifies the validity of these documents at registration but does not personally guarantee the performance of the transport, which is the sole responsibility of the driver. As the central booking system, NewRides provides a customer service for handling complaints relating to the performance of a ride.

9. Complaints and consumer mediation

For any complaint relating to a ride or a payment, the client may contact Customer Service at fredallieri@gmail.com. Failing an amicable resolution, consumers residing in the European Union have the right to refer the matter free of charge to a consumer mediator, in accordance with Articles L. 611-1 et seq. of the French Consumer Code. The contact details of the competent mediator will be published on this page once registration with an approved mediation body has been completed.

10. Personal data protection

The processing of personal data collected as part of booking and paying for rides is governed by the Privacy Policy, available shortly on this site, and by Article 6 of the Terms of Service.

11. Amendments to these Terms of Sale

NewRides reserves the right to amend these Terms of Sale at any time. The applicable Terms of Sale are those in force on the date of booking. Material changes will be communicated to registered users via the Service or by e-mail.

12. Governing law and jurisdiction

These Terms of Sale are governed by French law. Subject to any mandatory consumer-protection provisions applicable in their country of residence for clients residing in the European Union, any dispute will fall under the jurisdiction of the court of the client’s place of residence or, at NewRides’ choice, the court of the place of NewRides’ registered office.
