Terms of Service

These Terms of Service (“Terms”) govern access to and use of the newrides.fr website and the NewRides Customer and Driver applications (the “Service”), operated by NewRides. By registering or using the Service, you fully accept these Terms.

1. Description of the service

NewRides connects customers who need private hire vehicle (PHV) transport with independent professional drivers operating on the French Riviera, through a dedicated web app. NewRides acts as a technical intermediary between customer and driver: the ride is carried out by the driver, who remains responsible for driving the vehicle and complying with applicable passenger transport regulations.

2. Registration and account

To use the Service, you must create an account by providing accurate and up-to-date information (name, email, phone number and, for drivers, the documents required to verify professional eligibility). You are responsible for keeping your login credentials confidential and for all activity carried out through your account.

3. Booking and completion of rides

The customer requests a ride by indicating pickup, destination and the desired vehicle category; an available driver may accept the request. An estimated price is shown before confirmation; the final price may vary slightly depending on the actual route and traffic conditions at the time of the ride. The customer may cancel a ride before pickup; late cancellations may incur a fee, as indicated in the app at the time of booking.

4. Prices and payment

Rates are set by each driver based on time bands and vehicle category, and are shown to the customer before the ride is confirmed. Payment is made using the methods available in the app. Any applicable discounts or credits (see Article 5) are automatically deducted from the final price at the time of payment.

5. Loyalty discount and Referral Program

5.1 Loyalty discount. Every registered customer automatically receives a 5% discount on all rides and excursions booked through the Service, for the twelve months following their registration date. The discount is applied automatically at the time of payment and requires no action from the customer.

5.2 Referral Program. Every customer receives a personal referral code. When a new customer signs up using an existing customer’s code and completes payment for their first ride, the referring customer receives a €20 credit to use on future rides.

5.3 Annual cap. The referral credit that each customer can accumulate is limited to a maximum of €200 per calendar year of activity (calculated over the preceding twelve months).

5.4 How credit is used. Available credit is applied automatically at the time of payment, after the loyalty discount described in 5.1. On rides over €50, the entire available credit may be used on a single ride; on rides of €50 or less, the credit is used gradually, up to a maximum of 10% of the ride price per transaction.

5.5 General program conditions. Referral credit is not convertible into cash, is not transferable to third parties, and does not earn interest. NewRides reserves the right to modify, suspend or end the loyalty discount and Referral Program at any time, with effect on credits earned after the change; credits already earned remain valid, except in cases of fraudulent use of the program, in which case NewRides reserves the right to cancel them.

6. Liability

NewRides does not own the vehicles and is not the employer of the drivers, who operate as independent professionals. NewRides cannot be held liable for delays, damages or disputes arising directly from the driver’s performance of a ride, subject to mandatory legal provisions. Each driver is required to hold the authorizations, licenses and insurance coverage required by the regulations applicable to passenger transport.

8. Changes to these Terms

NewRides may update these Terms at any time. Changes will be published on this page with an indication of the last update date. Continued use of the Service after changes are published constitutes acceptance of the new Terms.

9. Governing law

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall fall under the jurisdiction of the courts of the place where NewRides is registered, unless otherwise required by mandatory consumer protection law.
